Paco — Terms of Service

These Terms apply only to the Android version of Paco distributed through Google Play. The iOS version remains subject to the terms applicable through Apple’s App Store.

1. Who we are and scope

These Terms of Service (“Terms”) govern your use of the Android application Paco (“Paco”, the “App”, “we”, “us” or “our”), provided by Francesco Margutti, postal address: Via Ca' Polverin 143, 31032 Casale sul Sile (Treviso), Italy; contact email: pacoapp.support@gmail.com.

By downloading, accessing or using Paco, you agree to these Terms. Your use of Google Play is also governed by the applicable Google Play Terms of Service. If a mandatory Google Play term or applicable law grants you rights that conflict with these Terms, that mandatory term or law prevails to the extent of the conflict.

2. Age, age bands and what changes for younger users

Paco is available to users of different ages, including children. The target audiences declared on Google Play are 6–8, 9–12, 13–15, 16–17 and 18+.

Paco asks for your year of birth only — never a full date — and uses it for one purpose: to determine which of three internal age bands applies to you (under 13, 13–17, or 18 and over). The year is stored on your device only. It is never transmitted to us or to any third party, it is not part of your saved game data and it is not included in any backup. It is kept on the device for one reason: so that your age band updates by itself as you grow older. Someone who answers at 17 is treated as an adult once the calculation reaches 18, without having to do anything. Because only the year is known, the app applies the more protective band whenever your birthday for the current year may not yet have passed.

You are asked once per installation. If you reinstall Paco or clear its data, you are asked again. The app does not provide a way to change the answer afterwards.

For users under 18, Paco works entirely on the device: no Paco account can be created, cloud backup and synchronization are not available, and optional usage analytics are neither collected nor offered. Advertising is shown, with the age-appropriate treatment described in section 8.

If you are below the age of legal majority in your country, you may use Paco only with the authorization of a parent or legal guardian where that authorization is required by applicable law. If local law requires parental or guardian authorization for purchases, subscriptions or other activities, you must obtain it before proceeding.

3. License to use Paco

Subject to these Terms and the applicable Google Play terms, you receive a non-exclusive, worldwide license to install, run, display and use Paco for your personal, non-commercial use. Any rights granted to you through Google Play remain unaffected. In-app products and subscription benefits are governed by the entitlement associated with the relevant purchase.

You may not copy, sell, rent, sublicense, redistribute, exploit, circumvent security features, interfere with the App, or reverse engineer Paco except where such restriction is prohibited by applicable law or where Google Play expressly permits the relevant use.

4. Accounts

The main learning and game features of Paco can be used without an account; cloud backup and synchronization require one. Account features — authentication, cloud backup and related services — are available only to users in the 18-and-over band described in section 2; for everyone else the app runs without an account and without cloud services. You are responsible for maintaining the confidentiality of your credentials and for activity performed through your account, except where applicable law provides otherwise.

You must provide accurate information and may not impersonate another person, misuse another person’s account or use Paco for unlawful or abusive purposes.

5. Paco Pro, subscriptions and in-app purchases

Paco may offer digital purchases through Google Play Billing, including:

  • Paco Pro monthly — an automatically renewing monthly subscription;
  • Paco Pro yearly — an automatically renewing yearly subscription;
  • Paco Pro Lifetime — a one-time purchase that provides Paco Pro access without recurring subscription charges for the lifetime of the Paco product/service, subject to these Terms, applicable law and the continued lawful availability of the service;
  • consumable digital items, such as Lifelines, Fertilizers and bundles containing in-app items.

The exact price, currency, taxes, billing period and any applicable offer are shown by Google Play before you confirm the purchase. The information displayed by Google Play at checkout governs the transaction. Digital purchases for the Android version are processed through Google Play Billing unless another method is expressly permitted by applicable Google Play policy and law.

Consumable items are virtual items for use only within Paco. They have no cash value and cannot be redeemed for money or transferred outside Paco, except where required by applicable law.

Important, please read before purchasing consumable items. Subscriptions and Paco Pro Lifetime are restorable through Google Play. Consumable items are not. They are part of Paco’s local saved data, and Google Play does not restore them if you uninstall the app, clear its data or move to a new device. Where cloud backup is available and you have enabled it, consumable balances are included in the backup and can be recovered that way. Users under 18 cannot use cloud backup (see section 2), so for them consumable items exist only on the device and are lost if that data is lost. This does not affect any non-waivable statutory right you may have.

6. Automatic renewal and cancellation

Monthly and yearly Paco Pro subscriptions renew automatically at the end of each billing period unless cancelled before the next renewal in accordance with Google Play’s rules. Charges are handled by Google Play using the payment method associated with your Google Play account.

You can manage or cancel your subscription through Google Play, including from the Google Play subscriptions area. Cancellation generally takes effect for the next billing period, and access normally continues until the end of the current paid period, subject to Google Play’s terms and applicable law.

Deleting your Paco account or uninstalling Paco does not automatically cancel a Google Play subscription. You must separately cancel the subscription through Google Play if you do not want it to renew.

7. Refunds and statutory rights

Refund eligibility is governed by the applicable Google Play refund policy, the terms applicable to your purchase, and mandatory consumer-protection law. Nothing in these Terms limits any non-waivable right of withdrawal, conformity, refund, repair, replacement or other remedy available to you under applicable law.

If a refund reverses a purchase, the related digital entitlement or item may be removed or disabled, as permitted by Google Play rules and applicable law.

8. Advertising and rewarded ads

Paco may display advertising to users who do not have an ad-free entitlement. Some advertising may be optional and rewarded, meaning that choosing to watch an eligible ad may grant a defined virtual in-app reward. Rewarded items have no cash value.

The treatment applied to advertising depends on the age band determined as described in section 2. Users under 13 receive the child-directed treatment provided by Google’s advertising technology, which excludes personalized advertising, remarketing and the use of the device advertising identifier. For users aged 13–17, Paco applies the “below the age of consent” signal as a precautionary measure to everyone in that band, without determining the age of consent that applies in each individual country; this also excludes personalized advertising. For all age bands the maximum ad content rating is limited to the rating suitable for general audiences. Further detail is given in the Privacy Policy.

Advertising, consent and age-related treatment are implemented in accordance with applicable law, Google Play policies and the App’s privacy disclosures.

9. Cloud backup, stored progress and account deletion

Paco offers cloud backup and synchronization to account users in the 18-and-over band (see section 2). Availability may also depend on network access, authentication and third-party infrastructure. You remain responsible for keeping access to your account and for following any backup or restore warnings shown in the App — in particular the warning shown when a cloud backup is older than the data on your device, since loading it may remove progress and purchased consumable items obtained after that backup.

Where account deletion is available, deleting a Paco account affects Paco account data as described in the Privacy Policy and on the Paco account deletion page. It does not cancel an active Google Play subscription.

10. App updates, changes and availability

We may update, improve, modify or discontinue features where reasonably necessary for maintenance, security, legal compliance, compatibility, product development or technical reasons. We do not guarantee that every feature will remain available indefinitely or that Paco will be uninterrupted or error-free.

Nothing in this section removes rights you may have for previously purchased content or services under Google Play terms or mandatory consumer law.

11. Intellectual property

Paco, its original software, design, branding, characters, illustrations, text and other original materials are protected by intellectual-property laws and remain the property of Francesco Margutti or the relevant rights holder. These Terms do not transfer ownership of Paco or its intellectual property to you.

12. Prohibited conduct

You must not use Paco to:

  • violate applicable law or third-party rights;
  • gain unauthorized access to accounts, systems, paid features or virtual items;
  • manipulate purchases, subscriptions, advertising rewards, backups, progress or entitlements;
  • introduce malware, disrupt the App or interfere with its security or operation;
  • use automated methods to abuse, overload or exploit Paco or connected services.

13. Third-party services

Paco relies on third-party platforms and services, which may include Google Play, Google Play Billing, Firebase, Google Mobile Ads/AdMob and consent-management technologies. Those services may be governed by their own terms and policies. Their operation, availability and processing activities are also subject to their respective rules and applicable law.

14. Privacy

Your use of Paco is also subject to our Privacy Policy, which explains the categories of data processed, purposes, retention, account deletion, advertising and third-party services. The Privacy Policy is available from Paco and from the app’s Google Play listing.

15. Disclaimers and limitation of liability

Paco is provided as a language-learning tool. While we aim to provide accurate and useful educational content, we do not guarantee that every exercise, explanation, translation or conjugation will be free of errors in every context.

To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or consequential losses resulting from use of, or inability to use, Paco. This limitation does not apply where liability cannot lawfully be excluded or limited, including mandatory consumer rights and any liability that applicable law makes non-excludable.

16. Suspension and termination

We may suspend or restrict access to Paco or an account where reasonably necessary to address fraud, abuse, security incidents, unlawful conduct or material breach of these Terms. Where appropriate and legally required, we will take into account proportionality and applicable consumer rights.

Termination or deletion does not automatically cancel Google Play subscriptions and does not eliminate rights or obligations that by their nature survive termination.

17. Changes to these Terms

We may update these Terms when necessary to reflect changes to Paco, legal requirements, Google Play rules or our services. The updated version will show a new “Last updated” date. Where required by law, we will provide additional notice or request renewed acceptance before material changes take effect.

18. Governing law and consumer protection

These Terms are governed by Italian law, without depriving consumers of the mandatory protections granted by the law of their country of residence. Any dispute will be handled by the courts or dispute-resolution mechanisms having jurisdiction under applicable mandatory law. Nothing in these Terms restricts rights that cannot legally be waived.

19. Google Play-specific terms

These Terms are an agreement between you and Francesco Margutti concerning Paco. They supplement, and do not replace, the terms governing your relationship with Google and Google Play. Google is not responsible for these Terms. To the extent of any conflict with mandatory rights or permissions granted through Google Play, the applicable Google Play terms prevail.
